1. Your agreement
Using a Nova product or service means you agree to these terms.
That includes downloading and running the software, and using any hosted service
Nova operates.
These terms sit alongside the Terms of Use, which
cover the Nova website more generally. Where an individual product publishes its
own terms or license, that document governs that product.
2. What Nova provides
Nova builds connected software for exploring, creating and building digital
worlds. The products described on this site include:
- NovaCut — desktop video and photo editing.
- Atlas — a local-first assistant with memory and context.
Products are at different stages. Some are in alpha, some are still in
development, and some are planned. A product being described here is not a
promise that it will ship, or that it will work in the way described when it
does.
Nova products are designed to run on your own hardware. Where a product works
without a network connection, we intend to keep it that way.
3. Eligibility and accounts
You must be old enough to enter into an agreement where you live in order to
accept these terms. If you are using Nova on behalf of an organization, you are
confirming you have the authority to accept these terms for it.
Nova does not currently require or offer an account. The
software runs without signing in. If a product introduces accounts later, you
will be responsible for the accuracy of your details, for keeping your
credentials secure, and for what happens under your account.
4. Acceptable use
Use Nova products for what they are for. In practice that means:
- Creating, editing and organizing your own work.
- Exploring and learning.
- Building software and experiences, within the terms of the relevant license.
- Using material you own, or that you are licensed or permitted to use.
5. Prohibited activities
You may not use Nova products or services to:
- Break the law, or help someone else break it.
- Distribute pirated, leaked or stolen material, or anything else you do not hold the rights to.
- Produce, seek or share sexual content involving minors. This is prohibited absolutely, and any report of it is treated as a critical safety matter.
- Harass, threaten, defame or stalk another person.
- Distribute malware, spyware, or code designed to damage or take control of someone's system.
- Probe, scan, overload or otherwise interfere with Nova services or the systems of others.
- Circumvent a technical limit, license check, or safety measure.
- Scrape or bulk-collect from Nova services in a way that degrades them for other people.
- Misrepresent modified software as an official Nova release.
6. Content and uploads
Your work stays yours. Nova claims no ownership of the projects,
media, code or notes you create with its products.
Today, Nova products store your work on your own machine. There is no upload
step, and nothing is sent to us as part of ordinary use.
If a future Nova service lets you upload or publish content, then for that
service:
- You keep ownership of what you upload.
- You grant only the permission needed to store, display and deliver it for the purpose you chose.
- You confirm you have the rights, licences or permissions needed to share it.
- You choose what is public, and what is not.
- Content that breaks these terms may be removed.
7. Copyright and intellectual property
The Nova name, logo, website and software are owned by
[Company/Legal Entity Name] or its licensors. Where a
component is released under an open-source license, that license governs it.
Nova does not knowingly host or distribute material that infringes someone
else's copyright. If you believe something made available through a Nova service
infringes your rights, contact getnovasupport@gmail.com
with enough detail to identify the material and your claim, and we will look
into it and remove infringing material where appropriate.
8. Abuse and security
If you find a security vulnerability in a Nova product, please report it to
getnovasupport@gmail.com rather than publishing it or
exploiting it. We would rather hear about it early.
Please do not test the security of Nova systems in ways that could affect other
people — that includes denial-of-service testing and automated attacks.
9. Service changes
Nova is under active development. Features will be added, changed and sometimes
removed, and products may move between alpha, development and release.
Where we can, we will give notice of a change that would break something you
rely on. Software already installed on your machine keeps working as installed
until you choose to update it.
10. Suspension and termination
You may stop using Nova at any time, and you may uninstall the software whenever
you like.
We may suspend or end access to a hosted Nova service if it is being used in a
way that breaks these terms, harms other users, or creates legal risk. Where
possible we will say why, and where the breach is minor we would rather resolve
it than remove access.
11. Third-party services
Nova products can work alongside services we do not control. Atlas, for example,
can be connected to an external model provider using a key you supply — that
connection is optional, off by default, and governed by that provider's own
terms.
When you choose to use a third-party service, its terms and privacy practices
apply to what it does. We are not responsible for those services.
12. Disclaimers
Nova products and services are provided "as is" and "as available", without
warranties of any kind, express or implied, to the fullest extent permitted by
law.
We do not warrant that a product will be uninterrupted, error-free, or suitable
for a particular purpose. Alpha and in-development software should be treated as
exactly that: keep backups, and do not rely on it for anything you cannot afford
to lose.
Where the law where you live does not allow a warranty to be excluded, this
section applies only as far as the law allows.
13. Liability
To the fullest extent permitted by law,
[Company/Legal Entity Name] is not liable for
indirect, incidental, special or consequential losses arising from your use of
Nova products or services — including lost profits, lost data, or lost work.
Nothing here limits liability that cannot legally be limited.
14. Updates to these terms
We may update these terms as the products change. The effective date at the top
of the page shows when the current version took effect.
For a significant change we will make an effort to flag it rather than relying on
you to notice. Continuing to use Nova after an update means you accept the
updated terms.
