The rules for using the Nova website and the software we make available.
1. Accepting these terms
These Terms of Use apply when you visit the Nova website or use software that Nova makes available. By using either, you agree to them.
If you do not agree, please do not use the site or the software. Individual Nova products may also have their own terms — where a product's own terms say something more specific, those apply to that product.
2. Using Nova
You may read this website, and you may download, install and use Nova software that is offered for download, for your own personal or business purposes.
Nova products are built to run on your own machine. Unless a specific product says otherwise, you do not need an account to use them, and using them does not require you to send us anything.
3. Accounts
Nova does not currently offer user accounts. Nothing on this site asks you to register, sign in, or create a profile.
If a Nova product introduces accounts in the future, this section will describe how they work. At that point you would be responsible for keeping your login details private and for activity that happens under your account, and you should tell us promptly if you believe someone else has access to it.
4. Your responsibilities
When you use Nova, you agree to:
- Use it lawfully, and in the ways these terms describe.
- Take responsibility for the files, projects and data you create or open with it.
- Keep your own backups of work that matters to you.
- Make sure you have the rights to any content you bring into a Nova product.
- Respect other people's rights, including their privacy and their copyright.
5. Things you may not do
Please do not:
- Use Nova to break the law, or to help anyone else break it.
- Upload, share or distribute content you do not have the rights to.
- Share sexual content involving minors, or anything that sexualises a child. This is never permitted, in any context.
- Attack, overload, or attempt to gain unauthorised access to Nova systems or anyone else's.
- Distribute malware, or use Nova to deliver it.
- Remove or obscure copyright notices, licences, or attribution.
- Impersonate Nova, or present modified software as though it were an official release.
- Resell or redistribute Nova software as your own product.
Where a Nova product includes a feature for reporting a problem or a piece of content, we ask that you use it rather than working around it.
6. Intellectual property
The Nova name, logo, website, written content and software are owned by [Company/Legal Entity Name] or its licensors, and are protected by copyright and trade mark law.
Using Nova does not transfer any of that ownership to you. Where a Nova product or component is released under an open-source license, that license governs what you may do with it, and it overrides this section for that component.
7. Content you create
What you make with Nova is yours. Projects, edits, recordings, notes and files you create using Nova software belong to you, and we claim no ownership of them.
Nova products are designed to keep your work on your own machine, in formats you can open elsewhere. Where a future product lets you publish or share something publicly, you would be giving us only the permission needed to host and display it for that purpose — and you would keep ownership of it.
You are responsible for having the rights to whatever you bring into a Nova product or share through one.
8. Third-party services and links
This website and Nova products may link to, or work alongside, services we do not control — an operating system, a hardware driver, a website you choose to open, or a model provider you choose to connect.
Those services have their own terms and their own privacy practices. We are not responsible for them, and linking to something is not an endorsement of it.
9. Service availability
This website is provided as it is, and may be unavailable at times — for maintenance, for technical reasons, or for reasons outside our control.
Nova software that runs on your own machine keeps working whether or not this website is up. That is deliberate, and it is one of the reasons the products are built the way they are.
10. Changes to Nova
Nova is actively being built. Products, features and this website will change, and some things described here may be added, altered, or removed.
We may also update these terms. When we do, we will change the effective date at the top of this page. If a change is significant, we will try to make that clear rather than leaving you to spot it. Continuing to use Nova after an update means you accept the updated terms.
11. Termination and suspension
You can stop using Nova at any time, and you can uninstall the software whenever you like.
We may suspend or withdraw access to this website, or to a hosted service we run, if it is being used in a way that breaks these terms or puts other people at risk. Where a Nova product runs entirely on your own machine, this does not reach into it.
12. Disclaimers
Nova is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, to the fullest extent permitted by law.
We do not promise that the website or the software will be uninterrupted, error-free, or fit for a particular purpose, and we do not promise that it will meet every requirement you have. Software in alpha or in development is especially likely to change and to contain defects.
Some jurisdictions do not allow certain warranties to be excluded. Where that is the case, this section applies only as far as the law allows.
13. Limitation of liability
To the fullest extent permitted by law, [Company/Legal Entity Name] is not liable for indirect, incidental, special or consequential losses arising from your use of Nova, including lost profits, lost data, or lost work.
Please keep your own backups. Nothing in these terms limits liability that cannot legally be limited.
